On Wednesday, February 22, 2017, The U.S. Department of Justice (“DOJ”) and the U.S. Department of Education (“DOE”) issued a “Dear Colleague” letter that withdrew two prior statements of policy and guidance regarding a school district's obligations towards transgender students. In response, the New York State Office of the Attorney General (“OAG”) and the New York State Education Department (“SED”) issued a joint statement, stating, in pertinent part, “that—irrespective of the federal government's decision—[school districts] have independent duties under state and local law to protect transgender students from discrimination and harassment in their schools and at all school functions.” Guercio and Guercio, LLP clients may view the entire memorandum in the Client Portal.
